Request a Classified and Proprietary Work Waiver

Purpose
Request a waiver to the University System of Maryland policy on classified and proprietary work, specifically publications.
Applicability
In highly unusual circumstances, Íøºì±¬ÁÏ, Baltimore President or designee may grant a waiver to the Policy on Classified and Proprietary Work in order for UMB to accept a sponsored award with restrictive publication terms. Such exception may only occur after Office of Research and Development (ORD) personnel have attempted to negotiate any term and conditions that require restriction and/or approval of publications.
Instructions
- Principal Investigator (PI)/Department administrator shall route any agreement for sponsored projects via Kuali Research or any other electronic means to submit documents to ORD.
- Office of Research and Development personnel will negotiate all terms and conditions of agreement to conform with University policies and State of Maryland laws.
- If Sponsor and ORD personnel fail to reach agreement on the publication terms, the PI may pursue a waiver from UMB President or designee to allow a waiver to the Policy on Classified and Proprietary work (Policy IV-2.20).
- Sponsored Programs Administration (SPA) will initiate the Publication Waiver Request form for completion by the PI. In some cases, the PI may be asked to meet with the Research Security manager or designee to help both SPA and the PI understand the consequences of accepting the publication restriction.
- The completed form will be sent to the PI’s Chair/unit head and the relevant Dean or Vice President or their designee for approvals, and then to the Chief Enterprise and Economic Development Officer and Senior Vice President and the President for final approvals.
- The PI will be notified via email upon final approval along with documentation of any related restrictions, instructions or concerns.
